У статті розглянуто сучасну нормативно-правову базу у сфері авіаційного землекористування України. У результаті вивчення та детального аналізу законодавчого забезпечення землекористування авіаційного транспорту потрібно зазначити, що попри той факт, що положення основоположних нормативних актів повинні бути взаємоузгоджені та врегульовані, оскільки відповідають за одну і ту ж саму сферу діяльності, непоодинокими є випадки, коли одне й те саме поняття регламентується із різних поглядів. Серйозною проблемою залишається сучасне регулювання приаеродромної території, правовий режим використання якої є основою для здійснення раціонального, екологобезпечного, економічно ефективного землекористування. Особливої уваги та досліджень потребує система екологобезпечного землекористування авіаційного транспорту. Запропоновано напрями вдосконалення законодавчого забезпечення авіаційного землекористування.
The article has considered the modern regulatory framework in the field of aviation land use of Ukraine. As a result of the study and detailed analysis of the legislative support of land use of aviation transport, it should be noted that despite the fact that the provisions of the basic regulations must be mutually harmonized and regulated, since they are responsible for the same field of activity, there are often cases when the same the concept is regulated from a different point of view, which causes conflicts of law. In particular, there is still no single concept as to the name of transport lands in the aviation industry. A serious problem remains the modern regulation of the airport area, the legal regime of which is the basis for the implementation of rational, environmentally friendly, cost-effective land use within the region where the airport is located. As of 2015, Annex 15 to the ICAO Convention has entered into force, according to which states whose airports (airports) are constantly receiving flights by international airlines must have clear digital data of the airport areas to be entered in the state registers. One should also take into account the fact that the State Target Program for the Development of Airports for the period up to 2023 defines the concepts of 10 airports to which the terms of Annex 15 of the ICAO Convention will apply. Today, only the Boryspil MA is digitized in Ukraine, and then only "district 2 - airfield". Improvement of the basic legislative acts in the field of land use of aviation transport include the following: regulation of the system of classification of lands of aviation transport and their delimitation; normative and legal consolidation of directions of the policy of ecologically safe land use; identification of land use restrictions, creation of their digital base and display in the State Land Cadastre. It is obvious that the legal differences of codes, laws and regulations must be resolved by amending the article presented, since ignoring the current situation may lead to a reduction in air traffic, which in turn may cause the loss of international economic and transport links. |
