Purpose: the article analyzes the issues of administrative and labor regulation and the identification of priority areas of research on problems of administrative and labor regulation in Ukraine. Research methods: comparative-legal, logical-semantic, system-structural. Results: it is considered advisable to consider priority areas related to the «work» category in the administrative law area. Discussion: legal regulation of labor and directions of such researches within the limits of administrative law. It has been established that the right to work can be realized also outside of labor relations. It is determined that the issues of legal regulation of labor are somewhat more extensive: they go beyond the scope of labor law, which a priori does not manage to solve their tools. It was found out that the basis for determining the term «labor» in the administrative law was the philosophical definition of this concept. The fact that labor is a purposeful activity of a person who needs physical or mental energy and is oriented on the creation of material and spiritual values. It is determined that the development of a system of effective administrative and legal measures aimed at promoting the effective realization of the rights of citizens to work, as well as to neutralize the consequences of the new market relations for Ukraine on the labor market, which is dangerous for the whole society, is being developed at the forefront of today’s Ukrainian administrative science. It is established that, despite the certainty of the subject of each of the branches of law, there are no solid boundaries between them. Sometimes there is a so-called «Mixed» spheres, which are formed «border objects of legal regulation». The problems faced by administrative scholars who are considering the concept of «labor» from the point of view of administrative law are described, and it is established that it is methodologically significant to distinguish between the main areas of work that are to be considered within the framework of administrative law. These areas include the following: the service activities of persons who are in the public (public) service; administrative-legal regulation of employment, labor migration and internal movement; administrative-legal protection of labor protection; consideration of disputes about the work of subjects of power. The article’s material will serve as a basis for further study of the issues of administrative and legal regulation of labor and the development of priority areas for research on the problems of administrative and legal regulation of labor in Ukraine.
Мета: у статті аналізуються питання адміністративно-правового регулювання праці та виокремлення пріоритетних напрямів досліджень проблем адміністративно-правового регулювання праці в Україні. Методи дослідження: порівняльно-правовий, логіко-семантичний, системно-структурний. Результати: визначено доцільність розгляду пріоритетних напрямів, пов’язаних із категорією «праця», у площині адміністративного права. Обговорення: правове регулювання праці та напрями таких досліджень в межах адміністративного права. |
