| Description |
Purpose: to formulate an algorithm of arguments based on current legislation that characterizes the place of indexation in the structure of monetary content for military services in the process of pension calculating. Research methods: legal analysis of legal provisions, empirical methods of research of jurisprudence, cognitive-analytical, as well as methods of systematization and generalizations. Results: proposes a normative approach to substantiate the basis for the exercise of the right of citizens (pensioners-servicemen) to include indexation in the base of cash provision in the calculation of pensions. Discussion: based on the analysis of the legislation, the authors concluded that indexation belongs to compensation institutions - is a compensation and, accordingly, income, to which paragraph 2, item 1, part 1 of Article 7 of Law No. 2464 accrues and pays the only contribution to compulsory state social insurance. The authors recommend that the authorities in the administrative proceedings apply the provisions of Article 41 of Law No. 1058-IV and recognize that this payment must be taken into account for the calculation of the pension to military personnel. In order to resolve legal conflicts, where there are differences between a general and a special legal act, according to the general rule, special attention is given. However, subsidiary application of general rules is possible, that is, in cases where the disputed legal relations are not regulated by the rules of special legislation or are not fully regulated. Despite the existence of special legislation, in particular Law No. 2262-XII and the relevant by-laws regulating relations for calculating pensions of servicemen from the sums of money in general, at the same time for legal relations arising from calculating the pension of military servicemen on the basis of statutory servicemen. When calculating a pension for servicemen in addition to special legislation, it is also necessary to apply subsidiarily the provisions of the general pension legislation for the calculation of a pension from indexation amounts that have not been adequately enshrined in special rules. Subsidiary application of these norms of law ensures that the pension rights of persons dismissed from military service are respected, avoiding discrimination in relation to the pension rights of other persons who did not receive such service.
Мета: сформулювати алгоритм аргументів, що базуються на чинному законодавстві, за допомогою якого характеризується місце індексації в структурі грошового забезпечення військовослужбовців у процесі нарахування пенсії. Методи дослідження: юридичного аналізу положень законодавства, емпіричні методи дослідження судової практики, пізнавально-аналітичний, а також методи систематизації та узагальнень. Результати: запропоновано нормативний підхід обгрунтування підстави реалізації права громадян (пенсіонерів-військовослужбовців) на включення індексації до бази грошового забезпечення при нарахуванні пенсії. Обговорення: відстоюється позиція, що мета та правова природа індексації дозволяє визнати її компенсацією, яка має бути врахована для обчислення пенсії військовослужбовцям; при нарахуванні пенсії військовослужбовцям, окрім спеціального законодавства, необхідно також субсидіарно застосовувати положення загального пенсійного законодавства щодо нарахування пенсії з сум індексації, які не знайшли відповідного закріплення в спеціальних нормах. |
