The purpose: the purpose of the article is to determine peculiarities of the aviation activity and, on the basis of the analysis of legal literature and normative legal acts, to propose an author’s definition of the said concept. Research methods: by using a dialectical cognition method to concentrate accumulated scientific knowledge and practice of applying the current legislation for the implementation of the aviation activity. Results: dased on the analysis of aviation activity legal definitions its components have been distinguished: 1) activity of legal entities and natural persons in aviation; 2) air traffic managment of Ukraine; 3) the use of airspace with the use of aircraft. An improved definition of aviation as an activity of legal entities of any organizational-legal form aimed at creation of conditions and use of airspace by a human through aircraft and other flying vehicles have been presented. Summarizing the mentioned above, it is possible to conclude that the issue of legal conceptual apparatus of aviation law improving remains relevant and requires further scientific research, in particular, in the definition of the concept of «aviation activity». That is why, the following definition of aviation activity has been suggested as organizational, productional, scientific and other activity of legal entities of any organizational-legal form and natural persons aimed at creation conditions and use of air space by means of aircraft and other flying vehicles, including air traffic service, airspace management and air traffic flow management that is performed safely, economically and efficiently by means of provision and continuous service in the interaction with all parties and involving airborne and ground-based functions. Discussion: problems of aviation activity, aviation, air space and aircraft.
Мета: визначити особливості правового регулювання авіаційної діяльності та на підставі аналізу юридичної літератури і нормативно-правових актів запропонувати авторське визначення зазначеного поняття. Методи дослідження: використання діалектичного методу пізнання дозволило концентрувати накопичені наукові знання та практику застосування законодавства щодо авіаційної діяльності. Результати: на підставі аналізу юридичної літератури, національного авіаційного законодавства запропоновано авторське визначення авіаційної діяльності. Обговорення: проблеми авіаційної діяльності, авіації, повітряного простору, повітряних суден. |
